US Court Grants WuXi AppTec Preliminary Injunction Over 1260H Listing
The US District Court for the District of Columbia has granted WuXi AppTec a preliminary injunction against the US Department of Defense's designation of the company to the 1260H list. The ruling, issued on August 7, 2026 US time, follows the company's lawsuit filed on June 11 and injunction motion on June 29. The injunction protects WuXi AppTec from immediate adverse effects of the designation while its legal challenge proceeds.
In an announcement released on August 9, 2026, WuXi AppTec disclosed progress in its legal challenge to the US Department of Defense's designation of the company to the 1260H list. The company had issued a voluntary announcement on June 12, 2026, confirming that it had initiated litigation over the designation.
WuXi AppTec formally filed suit against the Department of Defense in the US District Court for the District of Columbia on June 11, 2026, and on June 29 filed a motion for a preliminary injunction seeking to prohibit the Department from executing, implementing, or taking any other action on the basis of the designation.
The court held a hearing on the motion on July 22, 2026. On August 7, 2026 US time, the court ruled in favour of the company, granting the requested preliminary injunction. The ruling shields WuXi AppTec from immediate adverse effects of the designation while the judicial proceedings challenging the 1260H listing are pending.
