US Court Blocks Pentagon Listing of WuXi AppTec as Chinese Military Firm

US District Judge James Boasberg issued an order on August 7, 2026, overturning the Defense Department's decision to place WuXi AppTec on its Chinese military company list, citing a lack of factual evidence. The order blocks the Pentagon from enforcing its June 2026 blacklisting of the company. In his ruling, Boasberg noted that being labeled a 'Chinese military company' sends a signal to stay away, and since WuXi was added to the list, its customers and suppliers have cancelled contracts or ended long-term partnerships, shifting business to competitors and causing substantial commercial harm. The ruling also clarified that WuXi is not permanently removed from the list; the Defense Department may re-designate the company based on more substantial evidence.

Following the ruling, WuXi AppTec issued a statement welcoming the decision, saying it lifts the direct negative consequences the company faced during litigation due to the Defense Department's action. A company spokesperson emphasized that after an objective and fair judicial review, the facts will ultimately prevail. In earlier court proceedings, WuXi argued that the designation was 'arbitrary, capricious, and lacking factual basis' and was the product of political pressure. WuXi provided court data showing it employs about 450 people in the US, serves more than 1,000 American customers, and derived about 70% of its total revenue in 2025 from US clients. Most of its board members and senior executives are US citizens.

The Defense Department announced on June 8, 2026, that it would add more than a dozen Chinese technology, biopharmaceutical, and photovoltaic companies, including WuXi AppTec, to its 'Chinese military company list' (the 1260H list). Being listed does not constitute sanctions, but the Defense Department is prohibited from contracting with listed companies and, starting in 2027, will be fully barred from purchasing their products or services through third parties.
